📌 WHAT IS A NEW EXPORTER REVIEW?
Anti-dumping measures are generally imposed for a period of 5 years, but in practice they often remain in force for longer.
🟠 Exporters/producers who did not participate in the original investigation are typically subject to the highest rate of anti-dumping duty under the “all others” category.
Therefore, new exporters who begin exporting to Turkey after the original investigation period may apply for a New Exporter Review in order to have a fair and individualized dumping margin calculated.
📋 WHO CAN APPLY?
To qualify as a “new exporter,” a company must meet all three of the following conditions:
1️⃣ It did not export the product to Turkey during the original investigation period
2️⃣ It is not related to any of the companies subject to the anti-dumping duty
3️⃣ It has started or is contractually bound to start exporting to Turkey after the imposition of the measure
📝 If these conditions are met, a company-specific dumping margin is calculated and a potentially lower duty rate may be applied.
